Please read these terms carefully before using our services.

1. Acceptance of Terms

By downloading, installing, or using the Farmigo mobile application ("App") or visiting our website ("Site"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our services.

These Terms constitute a legally binding agreement between you and Farmigo ("Company," "we," "our," or "us").

2. Definitions

  • "Guest" refers to any user who searches for, browses, or books farmhouses, venues, or event spaces through the App.
  • "Owner" refers to any user who lists their farmhouse, venue, or event space for booking on the App.
  • "Listing" refers to any property or space made available for booking through the App.
  • "Booking" refers to a confirmed reservation made by a Guest for a Listing.
  • "Platform" refers to the Farmigo App and website collectively.

3. Eligibility

You must be at least 18 years of age to use Farmigo. By using our services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into binding contracts.

4. Account Registration

  • You must provide accurate, current, and complete information during registration.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

5. For Guests

5.1 Booking and Payments

  • All bookings are subject to availability and confirmation by the Owner.
  • Prices displayed on the platform are set by the Owners and may include applicable taxes and service fees.
  • Payment must be made through the payment methods available on the platform.
  • A booking is confirmed only after successful payment processing.
  • You agree to pay the total amount displayed at the time of booking, including any applicable service fees.

5.2 Guest Responsibilities

  • Treat the property with care and respect during your stay.
  • Follow all house rules set by the Owner.
  • Report any damages or issues promptly to the Owner and Farmigo.
  • Vacate the property at the agreed-upon time.
  • Do not engage in any illegal activities on the premises.

6. For Owners

6.1 Listing Requirements

  • All listings must contain accurate descriptions, photos, and pricing information.
  • Owners must have legal right to list and rent the property.
  • Listings are subject to review and approval by Farmigo.
  • Owners must maintain their listings with up-to-date availability and pricing.
  • False or misleading listings may result in account suspension.

6.2 Owner Responsibilities

  • Ensure the property meets safety and hygiene standards.
  • Honor all confirmed bookings.
  • Provide accurate descriptions and amenities as listed.
  • Respond to guest inquiries and messages in a timely manner.
  • Comply with all applicable local laws, regulations, and tax obligations.

6.3 Payouts

  • Farmigo will process payouts to Owners according to the payout schedule outlined in the Owner dashboard.
  • Farmigo may deduct applicable service fees and commissions from the booking amount before processing payouts.
  • Owners are responsible for providing accurate bank account information for payouts.

7. Service Fees

Farmigo charges service fees for facilitating bookings on the platform. The applicable fees are:

  • Guest Service Fee: A percentage of the booking subtotal, displayed before payment confirmation.
  • Owner Service Fee: A percentage deducted from the booking amount before payout.

Fee structures may change from time to time with prior notice.

8. Cancellations and Refunds

Cancellation and refund policies are detailed in our Refund Policy. By using Farmigo, you agree to abide by the applicable cancellation policy associated with each booking.

9. Reviews and Ratings

  • Guests and Owners may leave reviews and ratings after a completed booking.
  • Reviews must be honest, accurate, and based on personal experience.
  • Reviews must not contain offensive, defamatory, or discriminatory content.
  • Farmigo reserves the right to remove reviews that violate our guidelines.

10. Prohibited Activities

You agree not to:

  • Use the platform for any unlawful purpose.
  • Post false, misleading, or fraudulent content.
  • Harass, abuse, or threaten other users.
  • Attempt to circumvent the platform's payment system.
  • Scrape, crawl, or use automated tools to access the platform.
  • Impersonate another person or entity.
  • Interfere with or disrupt the platform's functionality.
  • Violate any applicable laws or regulations.

11. Intellectual Property

All content on the Farmigo platform, including but not limited to text, graphics, logos, icons, images, and software, is the property of Farmigo or its content suppliers and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

12. Limitation of Liability

Farmigo serves as a platform connecting Guests with Owners. We do not own, manage, or control any listed properties. Therefore:

  • We are not liable for the condition, safety, legality, or suitability of any listed property.
  • We are not liable for the actions or omissions of Guests or Owners.
  • We are not liable for any injuries, damages, or losses arising from the use of listed properties.
  • Our total liability to you for any claim arising from or related to these Terms shall not exceed the amount of fees paid by you to Farmigo in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold Farmigo, its officers, directors, employees, and agents harmless from any claims, damages, losses, liabilities, and expenses arising out of your use of the platform or violation of these Terms.

14. Dispute Resolution

In case of disputes between Guests and Owners, Farmigo may, at its discretion, mediate and attempt to resolve the issue. Farmigo's decision in dispute resolution shall be considered final. Any legal disputes shall be governed by the laws of Pakistan and shall be subject to the exclusive jurisdiction of the courts in Pakistan.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or email. Your continued use of the platform after such modifications constitutes acceptance of the updated Terms.

16. Termination

We may terminate or suspend your account and access to the platform at any time, without prior notice, for conduct that we determine violates these Terms or is harmful to other users, us, or third parties.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to its conflict of law provisions.
